Acceptable Use Policy

This Acceptable Use Policy (“AUP”) outlines acceptable and prohibited uses of services, systems, networks, applications, websites, and digital resources provided, managed, or supported by Obsidian Digital Technologies LLC (“Company,” “we,” “us,” or “our”).

1. Purpose

This policy exists to:

  • Protect clients, users, and third parties
  • Maintain system integrity, availability, and security
  • Comply with applicable local, state, federal, and international laws
  • Prevent misuse, abuse, or unlawful activity

Use of our services constitutes acceptance of this policy.

  • All clients, customers, contractors, partners, and authorized users
  • All systems, websites, applications, hosting, email, IT support, and cybersecurity-related services provided by Obsidian Digital Technologies LLC
  • Any device, account, or credential accessing services we manage or support

3. Acceptable Use

Users may only use services in ways that are:

  • Ethical
  • Consistent with agreed service terms

Permitted activities include:

  • Legitimate business operations
  • Website hosting and development for lawful content
  • IT configuration, maintenance, and troubleshooting
  • Cybersecurity readiness, configuration, monitoring, and education
  • Email, application, and digital system use for intended purposes
  • Reasonable testing and troubleshooting authorized in writing by the client

4. Prohibited Activities

The following activities are strictly prohibited, whether intentional or unintentional:

Illegal or Harmful Conduct

  • Violating any applicable law or regulation
  • Facilitating fraud, scams, or deceptive practices
  • Distribution of malware, ransomware, spyware, or malicious code
  • Unauthorized access to systems, networks, or data

Security Violations

  • Attempting to bypass authentication, authorization, or security controls
  • Exploiting vulnerabilities without written authorization
  • Credential harvesting, brute-force attacks, or scanning without approval
  • Interfering with system integrity, availability, or performance

Abuse of Services

  • Excessive resource consumption that disrupts services
  • Spamming, phishing, or bulk unsolicited communications
  • Hosting or distributing illegal, infringing, or abusive content
  • Using services to harass, threaten, or harm individuals or organizations

Intellectual Property Violations

  • Uploading or distributing copyrighted material without authorization
  • Infringing trademarks, trade secrets, or proprietary data
  • Reverse-engineering systems without permission

5. Client Responsibilities

Clients are responsible for:

  • Maintaining the confidentiality of their credentials
  • Ensuring their users comply with this policy
  • Promptly reporting suspected security incidents or breaches
  • Maintaining lawful content and activities within systems we manage
  • Providing accurate and truthful information

Clients remain fully responsible for data they store, transmit, or process unless otherwise stated in a written agreement.

6. Cybersecurity Disclaimer

Obsidian Digital Technologies LLC provides cybersecurity readiness, configuration, monitoring support, and educational services.

We do not:

  • Guarantee breach prevention
  • Provide unauthorized penetration testing
  • Engage in hacking, exploitation, or illegal surveillance
  • Assume liability for third-party attacks outside our control

Security is a shared responsibility between the Company and the client.

7. Monitoring & Enforcement

To protect systems and comply with legal obligations, we may:

  • Monitor usage for security, compliance, and operational purposes
  • Investigate suspected violations
  • Suspend or terminate services without notice for violations
  • Report unlawful activity to appropriate authorities when required

Monitoring is conducted in accordance with applicable privacy laws.

8. Consequences of Violation

Violations of this policy may result in:

  • Immediate suspension or termination of services
  • Removal of content or access
  • Legal action
  • Financial liability for damages, remediation, or legal costs

No refunds will be issued for terminations due to policy violations.

9. Policy Updates

We reserve the right to modify this policy at any time. Updates will be posted on our website or provided to clients. Continued use of services after changes constitutes acceptance.
